PREAMBLE

These terms and conditions govern the contractual relations relating to the sale of individual stays between the company HOTEL BEAU RIVAGE and its customers.

They regulate all the steps necessary for the booking and payment of the stays, and regulate all their follow-up between the contracting parties.

In the case of bookings by professionals or for groups, the T&Cs are supplemented and adapted by the special conditions.

HOTEL BEAU RIVAGE makes its best efforts to ensure that its commercial documents, and in particular leaflets, advertisements and catalogues, are as faithful as possible to the services offered. However, it is possible that the Client’s perception of the photographic representation of the services does not correspond exactly to the services themselves. Their purpose is therefore essentially informative. The General Terms and Conditions are available on the WEBSITE (https://www.hotel-beaurivage.com/).

RESPONSIBILITY OF HOTEL BEAU RIVAGE

HOTEL BEAU RIVAGE makes every effort to ensure that the photographs, graphic representations or texts used give as accurate an overview as possible of the accommodation and services offered. However, the photographs presented are non-contractual and variations may occur, in particular due to changes in furniture or possible renovations.

DEFINITIONS

“WEBSITE” means the www.hotel-beaurivage.com website .

“HOTEL BEAU RIVAGE” refers to the company HOTEL BEAU RIVAGE, S.A.S with a capital of €2,759,916.00, registered with the Lyon Trade and Companies Register under number 957 509 409, whose registered office is located at 2 rue Beau Rivage, 69420 Condrieu, represented by its legal representative in office.

“ROOMS” means the rooms and suites of the hotel..

“STAYS” refers to the offer of a BED or a ROOM accompanied, where applicable, by free or paid additional services.

“CUSTOMER” refers to any person booking a STAY and/or any services offered by HOTEL BEAU RIVAGE on the WEBSITE , by telephone, by post or directly at the hotel reception. The CLIENT acknowledges that he or she has the capacity to enter into a contract, i.e. in particular that he or she is of legal age and that he or she is not subject to a protection measure, or failing that, he or she has the authorisation of his or her guardian or curator if he or she is incapable.

ENTIRETY

These terms and conditions express the entire obligations of the parties. In this sense, the CLIENT is deemed  to accept them without reservation and in accordance with the provisions of Article 1126 of the Civil Code.

These general terms and conditions of sale and booking of stays at the HOTEL BEAU RIVAGE apply to the exclusion of all other conditions.

They are accessible on the www.hotel-beaurivage.com website and will prevail, where applicable, over any other version or any other contradictory document.

HOTEL BEAU RIVAGE and the CLIENT agree that these general terms and conditions exclusively govern their relationship. HOTEL BEAU RIVAGE reserves the right to modify its general terms and conditions from time to time. They will be applicable as soon as they are put online .

If a condition for booking a stay were to be missing, it would be considered to be governed by the practices in force in the hotel sector, whose companies have their registered office in France.

PRE-CONTRACTUAL INFORMATION

The CUSTOMER acknowledges that he or she has been informed, prior to booking , of these general terms and conditions of sale, rental and stays, and of all the information listed in Article L. 111-1 of the Consumer Code.

The customer has all the information online or can also obtain any details on the services offered by phone on 04 74 56 82 82.

SERVICES AND PRICES

1.  Stay in ROOM:

HOTEL BEAU RIVAGE offers different types of ROOMS , the descriptions of which are presented on the website, which can accommodate 1 to 4 people depending on the type of room chosen.

The description, minimum stays and rates vary according to the season; they can be consulted on the WEBSITE by entering the dates of stay.

Services included in the price

The price of the ROOM: This is a fixed price per night of occupancy for the type of ROOM concerned. The basic package includes one night for 1 or 2 people, bed linen and towels, housekeeping, access to the hotel’s wifi and access to the hotel’s services. For security reasons, the number of people may not exceed the capacity of the CHAMBER. The hotel reserves the right to refuse access to the ROOM to any person beyond the planned capacity.

The ROOMS are non-smoking.

ARRIVALS AND DEPARTURES – PROVISION OF BEDS / ROOMS

Check-in at the reception of the CLIENT upon arrival is mandatory; it constitutes proof of the start of the stay

ROOMS are available from 3pm on the day of arrival and must be vacated by 11am on the day of departure.

In case of arrival after 9 p.m., the CUSTOMER is required to notify the hotel.

ASSIGNMENT, SUBLETTING

All bookings are nominative; It cannot be transferred without the prior agreement of HOTEL BEAU RIVAGE.

EVOLUTION OF TARIFFS

Prices are dynamic and may change as the season progresses. HOTEL BEAU RIVAGE cannot be held responsible for any difference in cost between two stays booked for the same period.

The rates indicated are in euros, including VAT at the rate in force at the time of the booking date of the STAY. The total price of the STAY includes the price of the rental of the ROOMS or BEDS, the additional services chosen, the booking fees. This total price is indicated prior to the validation by the CUSTOMER of the reservation of his STAY or that the reservation is made on the WEBSITE or through another booking channel. Any change or modification of the rate as well as any change in the taxes applicable to the stay, on the date of invoice, may be reflected in the price of the stay

TOURIST TAX

The tourist tax collected on behalf of the municipalities and to be paid, is not included in our rates. Its amount determined per person and per day varies according to the destination and could be modified during the year.

PROMOTIONS

Promotional offers are subject to certain conditions, including availability. In addition, price reductions or promotional operations cannot be combined with each other, unless otherwise stated, and are not retroactive.

On these occasions, it is possible that for the same stay, customers have paid different prices. Customers who have paid the highest price will not be entitled to a refund of the difference between the price they paid and the promotional price.

BOOKING AND PAYMENT

1) BOOKING CONDITIONS

The customer has the option of making their reservation online, by phone or by email, based on the presentation of the rooms and services offered on the WEBSITE.

All bookings must be accompanied by a bank guarantee or a payment in accordance with the pricing conditions chosen by the CLIENT

HOTEL BEAU RIVAGE draws the CUSTOMER’s attention to the fact that regardless of the channel chosen, the reservation becomes effective only after HOTEL BEAU RIVAGE has sent the written confirmation of the reservation by email after receipt of the amount due or communication of the bank guarantee.

This written booking confirmation contains the details of the booking made by the CLIENT as well as all the information relating to his STAY.

2) SPECIAL BOOKING CONDITIONS ON WEBSITE

Regarding bookings on the WEBSITE, in order for the order to be validated, the CUSTOMER must, after having previously read them, accept these General Terms and Conditions by clicking on the indicated place and validate their booking.

Following their booking, the CUSTOMER will receive a confirmation by email containing the details of their STAY (content of the services, dates and duration, prices and payment terms ).

Electronic signature applicable to online sales

The online provision of the customer’s credit card number and the final validation of the order will constitute proof of the customer’s agreement :

  • due for the reservation,
  • signature and express acceptance of all operations carried out.

In the event of fraudulent use of the bank card, the buyer is invited, as soon as this use is observed, to contact HOTEL BEAU RIVAGE on 04 74 56 82 82.

3) PAYMENT OF THE STAY

The full price of the STAY is payable with the FLEX and SEMI FLEX rates upon arrival at the hotel.

The full price of the STAY is payable with the NO FLEX rate immediately upon booking.

4) RIGHT OF WITHDRAWAL

According to Article L. 221-28 12° of the Consumer Code, the right of withdrawal is not applicable to accommodation, transport, catering and leisure services provided on a specific date or at a specific interval.

5) PAYMENT METHODS

When booking on the WEBSITE or directly with the hotel, the payment of the entire STAY or the communication of the bank guarantee is made online on the WEBSITE (different means of payment are offered depending on the country/language of navigation on the WEBSITE including: credit cards, BCMC,  IDEAL, PayPal,…) or via a payment link sent by the hotel. The transaction is immediately carried out on the CLIENT’s bank card after verification of the data on the latter. By providing their credit card information, the CUSTOMER authorises HOTEL BEAU RIVAGE to debit their credit card for the amount due at the time of booking (in the event of a reservation without payment in advance, no amount will be debited). To this end, the CLIENT confirms that he is the holder of the bank card communicated and that the name appearing on his bank card is indeed his own.

Other accepted methods of payment are: cash in euros only at the hotel reception and by cheque in euros up to 30 days before arrival.

Cheques are not accepted for on-site payment.

VEHICLE PARKING

It is possible to reserve a parking space in the hotel’s garage. The nightly rate is available on the WEBSITE or directly from the hotel. As the number of places is limited, HOTEL BEAU RIVAGE cannot guarantee availability.

MODIFICATION OF STAY

Modification by the CLIENT : Any change in dates or type of accommodation is considered a modification of the STAY. The modified STAY, when the modification is possible, must take place before December 31 of the current year. No postponement beyond that is possible. If the amount of the new STAY is higher than the initial STAY, the CLIENT will have to pay the difference. Otherwise, the price difference will not be refunded.

The possibilities of modifying the STAY vary according to the rate chosen by the CLIENT and as specified in the conditions associated with the rate on the WEBSITE. No changes to your stay are possible with the “NO FLEX” rate.

Modification by HOTEL BEAU RIVAGE : In the event that HOTEL BEAU RIVAGE is obliged to modify the services initially provided for the STAY, it will make every effort to provide similar services; the CUSTOMER may either accept the modification or terminate the Contract and obtain a refund of the sums paid, under the conditions set out in Article L 214-1 of the Consumer Code.

CANCELLATION OF STAY

Cancellation by HOTEL BEAU RIVAGE (except in cases of force majeure): in the event of cancellation before the CLIENT’s departure from his/her place of residence to the hotel, the sums paid by the CLIENT will be reimbursed in full by HOTEL BEAU RIVAGE after notification of the cancellation by email or post with acknowledgement of receipt and under the conditions referred to in Article L214-1 of the Consumer Code. In the event of cancellation after the CLIENT has left their place of residence to the HOTEL BEAU RIVAGE undertakes to offer the CLIENTS an equivalent STAY by possibly bearing any additional price and, if the services accepted by the CLIENT are of inferior quality, HOTEL BEAU RIVAGE will refund the difference.

Cancellation (total or partial) by the CLIENT : The possibilities of cancelling the STAY vary according to the rate chosen by the CLIENT. No cancellation of a stay is possible with the “NO FLEX” rate.

If the CUSTOMER wishes to cancel, he must notify HOTEL BEAU RIVAGE either by sending a letter to the following address: HOTEL BEAU RIVAGE, 2 rue Beau Rivage, 69420 Condrieu, or by sending an email to the address infos@hotel-beaurivage.com. HOTEL BEAU RIVAGE draws the CLIENT’s attention to the fact that in the absence of cancellation under the conditions set out in this article, the CLIENT will be required to pay all sums due under the contract. The date of the acknowledgement of receipt of the cancellation letter/ email will determine any cancellation fees.

Non-consumption of ancillary services :

Additional services booked by the CLIENT and not used by the CLIENT do not give rise to any refund.

STAYS/OFFERS/RATES NON-VOIDABLE AND MODIFIABLE

HOTEL BEAU RIVAGE can offer STAYS at preferential rates called “NO FLEX” on specific dates which are non-modifiable , non-refundable, non-exchangeable.

Consequently, no request for modification or cancellation will be taken into account by HOTEL BEAU RIVAGE: no refund can be made, including the reimbursement of additional services that have been booked in addition.

LATE ARRIVAL, EARLY DEPARTURE

In the absence of an information message from the CLIENT by any means specifying that he or she has had to postpone the date of his or her arrival, the ROOM becomes available again 24 hours after the date of arrival provided for in the Contract, and full payment of the services remains required.

No discount will be granted in the case of an early departure in the case of a NO FLEX fare.

PAYMENT AT THE END OF THE STAY OF EXPENSES ON SITE (STAY BILL)

The CUSTOMER is free to use or not the end-of-stay payment option for their purchases of products and services on site, which is activated with a security deposit. If they do not wish  to benefit from it, they will simply have to pay for their purchases of products or services directly from HOTEL BEAU RIVAGE, by cash (within the limit of the regulatory limit), or by credit card.

All expenses incurred by the CLIENT in connection with the payment at the end of the stay are subject to an invoice to be paid at the latest at the time of departure. This payment is made automatically by debiting the CLIENT’s card at the end of the stay, unless the Client makes a payment up to the day before their departure. The CLIENT can pay the amount of his expenses at the reception.

In the event of a dispute by the CLIENT of one or more transactions attributed to him/her, he/she must notify the receipt as soon as possible, which will take the necessary measures. In the event of non-payment by the CUSTOMER of all or part of the expenses recorded during their stay as part of the payment at the end of the stay, the amount due may be debited by HOTEL BEAU RIVAGE. The direct debit is made within 8 days of the CLIENT’s departure.

RENTAL OF ANCILLARY EQUIPMENT

Depending on availability, the CUSTOMER may rent additional equipment (bicycles, etc.) when booking the STAY or directly from the hotel during their STAY. The rented equipment is deemed to be delivered to the CLIENT in good working order. It is the responsibility of the CLIENT to ensure that the rented ancillary equipment is used in accordance with normal and reasonable use and to take all necessary precautions for the use of the same.

MINOR

Minors who are not accompanied by their parents are not accepted in the HOTEL BEAU RIVAGE.

ANIMALS

Pets are allowed at the hotel for an extra charge.

INTERNAL RULES

In order to facilitate the progress of the stay of all our guests, internal rules are available on the website WEB or at the reception. CUSTOMERS are requested to read and comply with it. In the event of non-compliance with these regulations, the hotel management may take sanctions up to and including termination of the contract without compensation. In particular, we draw the attention of GUESTS to the fact that there must be total silence between 10 p.m. and 7 a.m., both inside and outside the hotel.

PERSONAL DATA

The implementation of a privacy policy by HOTEL BEAU RIVAGE is explained by its desire to inform the CUSTOMER about the nature of the personal data that may be collected when booking STAYS, the reason for their collection, the way in which they may be used and the rights they have over this data. In addition to these terms and conditions, HOTEL BEAU RIVAGE invites the CUSTOMER to consult its privacy policy accessible via the following link: https://www.hotel-beaurivage.com/  legal notices/, which is an integral part of these terms and conditions.

FORCE MAJEURE

The occurrence of a force majeure event within the meaning of Article 1218 of the Civil Code (i.e. any event beyond the control of the debtor and which could not reasonably have been foreseen at the time of the conclusion of the contract and the effects of which cannot be avoided by appropriate measures), will result in the suspension of the parties’ obligations under the Contract.

The party invoking a case of force majeure as previously referred to shall immediately notify the other party of its occurrence by any written means. The parties will come together to examine the impact of the event and agree, if necessary, on the conditions under which the performance of the Contract can be resumed.

If the case of force majeure lasts longer than three weeks , the Contract will be terminated by operation of law.

Any circumstances beyond the control of the parties that prevent the performance of their obligations under normal conditions are considered as grounds for exemption from the obligations of the parties and lead to their suspension.

The party invoking the circumstances referred to above must immediately notify the other party of their occurrence and disappearance.

Force majeure shall be considered as any irresistible facts or circumstances beyond the control of the parties, external to the parties, unforeseeable, unavoidable, beyond the control of the parties and which cannot be prevented by the parties, despite all reasonable efforts. Specifically, the following are considered to be as a case of force majeure or fortuitous events, in addition to those usually held by the jurisprudence of the courts and French courts: storms, floods, lightning, earthquakes earth, fires, block some means transport or supplies, epidemic or pandemic.

The parties will come together to review the impact of event and agree on the conditions under which the performance of the contract will be continued.

If the case of force majeure lasts longer than three weeks , the accommodation rental contracts will be terminated by operation of law.

PARTIAL NON-VALIDATION

If one or more provisions of these general terms and conditions are held to be invalid or declared as such pursuant to a law, regulation or following a final decision of a competent court, the other provisions shall retain their full force and scope.

NON-WAIVER

The fact that one of the parties does not invoke a breach by the other party of any of the obligations referred to in these general terms and conditions cannot be interpreted in the future as a waiver of the obligation in question.

LANGUAGE OF THE CONTRACT

These general terms and conditions of sale are written in French. In the event that they are translated into one or more foreign languages, only the French text will be authentic in the event of a dispute.

DISPUTE RESOLUTION – MEDIATION

For French nationals and European Union nationals , in the event of any dispute that arises regarding the validity, interpretation, performance or non-performance, modification or termination of the contract, the customer and HOTEL BEAU RIVAGE will endeavour to find a solution amicable. To this end, the customer must send his complaint by registered mail with acknowledgement of receipt to HOTEL BEAU RIVAGE, 2 rue Beau Rivage, 69420 Condrieu or by email to: infos@hotel-beaurivage.com within one month of the stay.

In the absence of a satisfactory follow-up and in accordance with Article L. 612-1 of the Consumer Code, within one year of his written complaint, the customer, subject  to Article L.152-2 of the Consumer Code, has the option of submitting a request for amicable resolution by mediation.

GOVERNING LAW

These general terms and conditions are subject to the application of French law, subject to mandatory provisions from which the parties may not derogate.
